UK cosmetic market

Since Brexit (2020) the cosmetic framework has evolved significantly with the establishment of distinct regulatory processes for Great Britain (GB) and Northern Ireland.

The primary legislation regulating cosmetics in the UK is encapsulated in Schedule 34 of the Product Safety and Metrology Statutory Instrument, which is largely based on the EU Cosmetic Products Regulation (EC) No. 1223/2009 but includes specific UK adaptations.

Regulatory Authority

The Office for Product Safety and Standards (OPSS) is the competent authority responsible for enforcing these regulations in GB. The OPSS ensures compliance with safety, labeling, and advertising standards for all cosmetic products marketed in the UK.

Notification Process

All cosmetic products must be notified to the Submit Cosmetic Product Notification (SCPN) portal prior to being placed on the market.

Responsible Person

UK maintains the legal obligation to have a Responsible Person settled in the UK who ensures the responsibility of all cosmetic products sold on the UK market and ensures cosmetovigilance on the UK territory.

Labeling and Claims

Cosmetic products must adhere to strict labeling requirements that include:

  • An ingredients list ; Contact details of the RP; Necessary warnings

Claims made about products must be truthful and supported by evidence to avoid misleading consumers

Market Surveillance and Compliance Monitoring

The OPSS conducts market surveillance to monitor compliance with regulations. Any adverse reactions or serious undesirable effects associated with cosmetic products must be reported promptly by manufacturers or distributors. Fines apply in the case of non-compliance.
